WSB-TV: Mother wants justice for son killed opening wrong door at South Fulton gas station

In a tragic incident, Trayvon Dunnaville was fatally shot after mistakenly opening the wrong car door at a South Fulton gas station. Two years later, Dericole Daniel, the man accused of pulling the trigger, has been indicted on murder and other charges. Dunnaville’s mother, Tibitha, continues to grapple with the heartbreaking loss, questioning why Daniel resorted to deadly force.

Partner Chris Timmons provided legal insight during an interview with WSB-TV. Timmons said the delay in the indictment could be attributed to the time required to transfer the case from the solicitor general’s office or the complexities involved in the legal proceedings.

As a former prosecutor, Timmons explained the challenge of proving the shooting wasn’t in self-defense, emphasizing the importance of evaluating the incident from the defendant’s perspective. “You look at it from the perspective of the defendant—whether they believed they were in danger,” Timmons said. While video evidence likely shows an unjustified shooting, the case may still hinge on whether a reasonable person would have felt threatened in a similar situation.
