Fulton County Superior Court Judge Scott McAfee denied Kenneth Chesebro’s motion to withdraw his guilty plea in the Georgia 2020 election interference case. Chesebro, who pleaded guilty in October 2023 to a single count of conspiracy to commit filing false documents, had argued that his plea violated his constitutional right to due process. Judge McAfee dismissed the motion as procedurally defective.
Partner Chris Timmons, a Georgia trial lawyer and former prosecutor, explained the ruling. “Guilty pleas must be withdrawn within the same term of court a two-month period from the day they are entered. We’re over a year. He’s way out of time,” he said
Chesebro’s plea requires cooperation with prosecutors, potentially implicating co-defendants such as John Eastman and Rudy Giuliani. Wisconsin prosecutors have also filed new felony charges against Chesebro and others for similar schemes in battleground states.
