In a pivotal decision, the Georgia Court of Appeals bars Fulton County District Attorney Fani Willis from prosecuting the case against President-elect Donald Trump and his allies over alleged election interference. The court’s decision cites an “appearance of impropriety” linked to Willis’ previous romantic relationship with Nathan Wade, one of the lead prosecutors on the case, raising uncertainty about the future of the prosecution.
Legal experts, including partner Chris Timmons, expressed surprise at the decision, with Timmons noting, “It’s really unusual to see the Court of Appeals disqualify the DA’s office. That just doesn’t happen.”
Willis plans to appeal the ruling to the Georgia Supreme Court, but the path forward is uncertain, particularly with Trump’s potential return to office complicating matters.
If the ruling stands, the case could be handed to the Prosecuting Attorneys’ Council of Georgia, which would decide how to proceed.
